Terms of Service

By downloading, installing, or using the SafeDayz mobile application ("the App"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, please do not use the App.

These terms apply to everyone who accesses or uses the App.

Subject to your compliance with these Terms, Damurka grants you a limited, non-exclusive, non-transferable, revocable license to install and use SafeDayz on a device you own or control, for your personal reference use. This license does not grant you any ownership interest in the App — see Intellectual Property below.

When using the App, you agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the App's source code, except where applicable law expressly permits it.
• Resell, sublicense, rent, lease, or redistribute the App outside the official app store channels through which it was obtained.
• Use the App to build a competing product or service.
• Introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to the App or another user's device.
• Use the App for any unlawful purpose or in violation of applicable local, national, or international law.

The App — including its source code, design, user interface, branding, logos, and original content — is owned by Damurka and protected by copyright, trademark, and other intellectual property laws. These Terms grant you only the limited license described above; they do not transfer any ownership rights to you.

The SafeDayz name and logo are trademarks of Damurka. Google Play and AdMob are trademarks of Google, referenced here only to describe how the App uses those services.

The App is supported by advertising served through Google AdMob. Details on what data AdMob may process are set out in our Privacy Policy.

The App uses services operated by others — including Google Play and Google AdMob, described in more detail above and in our Privacy Policy. Damurka does not control, and is not responsible for, the content, accuracy, availability, or practices of any third-party service. Your use of those services is governed by their own terms and privacy policies, not ours.

You agree to enter accurate information (such as your last period start date and cycle length) when using the App's calculators. Inaccurate inputs will produce inaccurate estimates.

Your cycle data is stored only on your device. You are responsible for keeping your own backup of that information if you want it preserved — uninstalling the App, or losing or resetting your device, will permanently erase it, and Damurka has no copy to restore it from.

Damurka may suspend or terminate the license granted under these Terms, without notice, if you violate them — for example, by attempting to reverse engineer the App, as described in Restrictions on use above. Because the App runs locally on your device rather than through an account on our servers, termination generally means your right to use the App under these Terms ends.

You may stop using the App, and end this agreement, at any time by uninstalling it.

SafeDayz is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Damurka does not warrant that the App will be uninterrupted, error-free, secure, or that every calculation will be accurate in every circumstance.

To the fullest extent permitted by law, Damurka shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including any health, family-planning, or data-loss outcome — arising from your use of, or inability to use, the App, even if advised of the possibility of such damages. The App is provided free of charge, and Damurka's total liability for any claim arising from these Terms or the App is limited to the maximum extent permitted by applicable law.

These Terms are governed by the laws of Kenya, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Kenya.

We may update these Terms of Service from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the App after changes take effect constitutes acceptance of the revised terms.
